Summary

• Copyright Responsibility: The customer must own or have the right to use the submitted photograph(s).
• Indemnity: The customer indemnifies the artist against any copyright claims if they do not have the proper rights.
• Artist’s Usage Rights: The artist can use images of the finished artwork for marketing, even if only a deposit was paid.
• Payment Terms: A non-refundable deposit is required upfront; the remaining balance must be paid before delivery.
• Unpaid Balance: If the customer does not pay the balance within 6 weeks, the artist retains the artwork and all rights to it.
• Late Payment Consideration: The artist may still deliver the artwork later at their discretion if the balance is paid.
• Approval & Alterations: No further payment is needed if the customer does not approve the artwork. Alterations may be considered for an additional agreed fee.
• Liability Limitations: The artist is not responsible for dissatisfaction due to personal taste; liability is limited to the amount paid.
• Legal Jurisdiction: These terms are governed by English and Welsh law, with disputes handled in their courts.
